Terms of Service
The short version
Play the game, enjoy it, don't tamper with it or pass it off as your own. Coins and shells are local game state with no real-world value, and there is nothing to buy. The game is provided as it is.
01Agreement
These Terms of Service (the "Terms") form an agreement between you and COMTECH WATER SYSTEM CORP. ("we", "us") covering your use of the mobile game True Detent: Gears (the "Game") and this website.
By downloading, installing or playing the Game you agree to these Terms. If you do not agree to them, do not install or play the Game. Our Privacy Policy forms part of this agreement.
02Licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play the Game on devices you own or control, for your own private, non-commercial entertainment.
This is a licence, not a sale. We and our licensors keep all rights in the Game that these Terms do not expressly grant you.
03Eligibility
The Game is suitable for a general audience and collects no personal data. If you are a minor in your jurisdiction, please make sure a parent or guardian is comfortable with you installing it. If you are using a device that belongs to someone else, make sure you have their permission.
04Coins, seals and shells
The Game contains virtual items — coins earned from repairs, seals in the Keeper's Log, and shells for Vernier. You should understand clearly what these are:
- They are earned by playing only. The Game contains no in-app purchases. Coins cannot be bought with real money.
- They have no monetary value. They are not currency, credit, property or a financial instrument, and they cannot be exchanged for money or anything of real-world value.
- They exist only on your device. They are entries in your local save file. They are not held in an account and cannot be transferred, sold, gifted or recovered.
- They can be lost. Deleting the Game, resetting your save, or losing or replacing your device will remove them permanently, and we cannot restore them.
We may change the balance, cost or availability of any virtual item in future versions of the Game as part of ordinary game design.
05Acceptable use
You agree not to:
- Copy, modify, translate, reverse engineer, decompile or disassemble the Game, except where a law expressly allows it despite this restriction
- Distribute, sell, rent, sublicense or publicly perform the Game, or make it available to others as a service
- Use cheats, modified clients, memory editors, automation or exploits to alter progress, coins or game state
- Remove, obscure or alter any copyright, trademark or other proprietary notice
- Use the Game or its assets to build a competing product, or represent the Game or its characters as your own work
- Use the Game for any unlawful purpose, or in breach of the rules of the platform you obtained it from
06Intellectual property
The Game and everything in it — code, artwork, the character Vernier and his shells, level design, user interface, sound, music and the names "True Detent: Gears" — is owned by us or our licensors and protected by copyright, trademark and other laws.
You may take screenshots and record video of your own play, and share that footage on social platforms, video sites or in reviews, including on monetised channels, provided you do not present the Game as your own work or imply that we endorse or sponsor you.
07App stores
You obtain the Game through a third-party platform such as the Apple App Store or Google Play. Your use is also subject to that platform's terms, and it may have its own rules on refunds and account handling that we do not control.
For the avoidance of doubt: Apple and Google are not parties to these Terms, are not responsible for the Game, and have no obligation to provide support for it. Any claim about the Game is between you and us. Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
08Updates and availability
We may release updates that change, add or remove features, and may stop supporting older versions or operating systems. We may also discontinue the Game entirely. We will try to give reasonable notice where we can, but we are not obliged to keep the Game available indefinitely.
Because the Game runs offline and saves locally, discontinuing it does not remove the copy already installed on your device.
09Disclaimer of warranties
The Game is provided "as is" and "as available", without warranty of any kind. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Game will be uninterrupted, error-free, or free of defects, or that your save data will never be lost or corrupted. Please do not treat a save file as something irreplaceable.
10Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress, virtual items, profits or goodwill, arising from or connected to your use of the Game.
Our total liability to you for any claim relating to the Game is limited to the greater of the amount you actually paid us for the Game, or USD 10.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply only to the extent permitted, and nothing in these Terms affects consumer rights you have that cannot be waived by agreement.
11Termination
This licence ends automatically if you breach these Terms. You can end it at any time by deleting the Game from your devices. Sections 04, 06, 09 and 10 survive termination.
12Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above and post the revised version on this page. Continuing to play the Game after a change means you accept the revised Terms.
